An employer can reasonably conclude that a case is likely not work-related if:
• The employee tells you s/he has been exposed to someone away from work that has a known case of
COVID-19
• The employee is the only worker to contract COVID-19 in his or her work area and the employee's duties don't
include contact with the public OR
• The employee is the only worker to contract COVID-19 and no cases have been confirmed at his/her customer
sites or other likely points of contact (gas stations or disposal sites for example)
According the SHRM article referenced above, an employer is required to determine the likelihood that the
employee contracted COVID-19 in the workplace only based on information reasonably available to it at the time
of its investigation. If you later find out that people on the employee's job sites—or the employee's entire softball
team—also have COVID-19, you can update your findings and OSHA documentation accordingly. v
