California Trucking Law Update ...continued By Karleen Kos, PSAI Executive Director The uneven experience of portable sanitation companies with enforcement to date seems to be due to lack of training and communication within the California enforcement community. It appears the Californ ia Highway Patrol is presently conducting training with law enforcement that will likely result in an increase of enforcement activity in the near future. While we cannot be certain when this will occur or how focused the efforts will be, it appears likely that portable sanitation companies should take steps to ensure drivers of vehicles carrying tanks of 1000 gallons or more possess a CDL with a tank endorsement. Note: This law applies to all drivers of vehicles that fall under California Vehicle Code requirements; that is, those involved in intra - state commerce in California. Vehicles that operate under Federal authority; that is, those engaged in inter - state operations crossing state lines, do not fall under the jurisdiction of the State of California as it applies to this requirement. Therefore, provided the Gross Vehicle Weight Rating of the "Tank Vehicle" is less than 26,001 lbs, these drivers are not required to have the endorsement. Join the conference call with CHP personnel.
