Antitrust Laws and Trade Associations. Trade associations represent most
industries. Like the PSAI, these groups seek to promote their sectors and help
their members succeed. It is important to remember, though, that there are
no special antitrust rules for trade associations, including the PSAI.
Trade associations must be mindful of the federal antitrust laws and take
steps to ensure there are no violations that occur.
To that end, the PSAI:
• Has an official antitrust policy published on its website at
psai.org/page/OrganizationalStructure
• Provides a copy of the policy annually to each member of the PSAI's
Board of Directors and all PSAI committees
• Provides a copy of the policy to the staff at the time of hire
• Retains legal counsel with expertise in association law
It is our goal to ensure the PSAI is lawfully and affirmatively
promoting the growth and positive reputation of the portable
sanitation industry and its members. When in doubt, trade
associations may apply to the Federal Trade Commission for
an advisory opinion regarding proposed rules that potentially
raise antitrust concerns. The PSAI will not hesitate to do this
should the proposed activities of the PSAI require it.
